利用規約

OB Lite は、Obsidian（Dynalist Inc.）とは無関係の非公式・非提携アプリです。「Obsidian」は Dynalist Inc. の商標であり、本サービスは Obsidian vault 形式と互換性のあるノートを扱う独立したサービスです。

本規約は、mahoroba works（以下「当方」）が提供する OB Lite（以下「本サービス」）の利用条件を定めるものです。本サービスを利用することで、本規約に同意したものとみなします。

第1条（サービス内容）

本サービスは、GitHubリポジトリに保存されたMarkdownノートをモバイル端末等から閲覧・編集するためのWebアプリケーション（PWA）です。無料プラン、無料トライアル、および買い切りの有料プラン（Pro）があります。

第2条（アカウントとデータ）

  1. 本サービスの利用にはGitHubアカウントが必要です。GitHubの認証情報（アクセストークン等）の管理はユーザーの責任で行うものとします。
  2. ノートの実体はユーザー自身のGitHubリポジトリに保存されます。当方はノートデータを保存せず、その保全について責任を負いません。重要なデータは必ずバックアップしてください。

第3条（未成年者の利用）

未成年者が本サービスを利用する場合、または有料プラン（Pro）を購入する場合は、親権者その他の法定代理人の同意を得た上で行うものとします。

第4条（Proライセンス）

  1. Proは買い切り型のライセンスで、購入時のGitHubアカウントに紐づきます。
  2. ライセンスの譲渡・転売はできません。
  3. デジタルコンテンツの性質上、決済完了後の返金はお受けできません（詳細は特定商取引法に基づく表記参照）。

第5条（禁止事項）

第6条（利用停止・ライセンスの無効化）

当方は、ユーザーが本規約に違反した場合、事前の通知なく、本サービスの利用停止またはProライセンスの無効化を行うことができます。この場合、購入代金の返金は行いません。

第7条（免責事項）

  1. 本サービスは現状有姿（AS IS）で提供され、当方はその完全性・正確性・特定目的への適合性について保証しません。
  2. 当方は、本サービスの利用または利用不能により生じた損害（データの消失・破損、GitHubトークンの漏洩による損害、機会損失等を含む）について、当方に故意または重過失がある場合を除き、責任を負いません。
  3. 当方が損害賠償責任を負う場合でも、その上限はユーザーが本サービスに支払った金額（Pro購入代金）とします。
  4. GitHub・Stripe・Cloudflare等の第三者サービスの障害・仕様変更に起因する不具合について、当方は責任を負いません。

第8条（サービスの変更・終了）

当方は、事前の通知の上、本サービスの内容を変更または終了することがあります。サービス終了時も、ノートの実体はユーザーのGitHubリポジトリに残ります。

第9条（規約の変更）

当方は必要に応じて本規約を変更することがあります。重要な変更がある場合は、本サービス上でお知らせします。変更後に本サービスの利用を継続した場合、変更後の規約に同意したものとみなします。

第10条（分離可能性）

本規約のいずれかの条項が法令により無効または執行不能と判断された場合であっても、残りの条項は引き続き有効に存続します。

第11条（準拠法・管轄）

本規約は日本法に準拠し、本サービスに関する紛争は東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Service

OB Lite is an unofficial, independent app not affiliated with Obsidian (Dynalist Inc.). "Obsidian" is a trademark of Dynalist Inc. The Service works with notes compatible with the Obsidian vault format.

These Terms govern the use of OB Lite ("the Service") provided by mahoroba works ("we"). By using the Service, you agree to these Terms.

1. The Service

The Service is a web application (PWA) for viewing and editing Markdown notes stored in your GitHub repository. It offers a free plan, a free trial, and a one-time-purchase paid plan (Pro).

2. Account and Data

  1. A GitHub account is required. You are responsible for managing your GitHub credentials (access tokens, etc.).
  2. Your notes are stored in your own GitHub repository. We do not store your notes and are not responsible for their preservation. Always back up important data.

3. Minors

If you are a minor, you may use the Service and purchase the paid plan (Pro) only with the consent of a parent or legal guardian.

4. Pro License

  1. Pro is a one-time-purchase license tied to the GitHub account used at purchase.
  2. Licenses may not be transferred or resold.
  3. Due to the nature of digital goods, purchases are non-refundable after payment (see the Legal Notice).

If you violate these Terms, we may suspend your access to the Service or revoke your Pro license without prior notice. No refund will be provided in such cases.

7. Disclaimer

  1. The Service is provided "AS IS", without warranties of completeness, accuracy, or fitness for a particular purpose.
  2. Except in cases of willful misconduct or gross negligence, we are not liable for damages arising from use of, or inability to use, the Service — including data loss or corruption, damages caused by leaked GitHub tokens, and lost opportunities.
  3. In any event, our total liability is limited to the amount you paid for the Service (the Pro purchase price).
  4. We are not responsible for issues caused by outages or changes in third-party services such as GitHub, Stripe, or Cloudflare.

8. Changes to or Termination of the Service

We may change or discontinue the Service with prior notice. Even if the Service ends, your notes remain in your GitHub repository.

9. Changes to These Terms

We may update these Terms as needed. Significant changes will be announced within the Service. Continued use after changes constitutes acceptance.

10. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any disputes.
